Recognition of citizenship by descendent – Jure Sanguinis

The minor child of an Italian citizen is automatically Italian. Most importantly, the birth certificate must be registered at the Consulate.

You are an Italian citizen by birth (even abroad) by paternal lineage (without generation limit) or by maternal lineage (only for those born after January 1, 1948).

Foreign citizens who have an Italian ancestor and who are legally resident in Oman can apply for recognition of Italian citizenship by descent (Jure Sanguinis) at this Consular office (residence must be demonstrated with a residence permit and / or certificate of residence issued by the Omani authorities).

Documentation to be submitted: kindly note that all documentation issued by foreign authorities must be presented in original with legalization or apostille and must be accompanied by a sworn translation with legalization or apostille. This procedure must be completed in the countries where the certificates are issued.

N.B. All civil status records of living beings cannot have a date of issue earlier than six months from the date of submission of the application.

Documentation related to the ancestor (Italian ancestor born in Italy / assignor):

Original birth certificate (Extract from the birth certificate) of the Italian ancestor, born in Italy and who gave rise to citizenship, complete with particulars of the parents. This document must be requested from the Italian municipality of birth of the ascendant.

Certificate of NON-NATURALIZATION of the Italian ancestor.

Marriage, possible divorces and death certificates of the Italian ancestor

IMPORTANT

From 1st January 2025, the consular fee according to art. 7-bis of the Consular Table attached to Legislative Decree 71/2011 for the application for recognition of iure sanguinis citizenship presented at diplomatic-consular offices abroad is 600 euros.

It should be noted that the payment is not related to the outcome of the application and is NOT refundable.

 

  1. IMPORTANT INFORMATION FOR APPLICANTS

This Italian Embassy accepts applications for Italian citizenship by descent from applicants who are legally permanent residents in this consular jurisdiction.

As such, to apply for Italian citizenship by descent through this Italian Embassy in Muscat, you must either be:

  • an Omani citizen residing in this consular jurisdiction;

OR

  • a foreign citizen with a PERMANENT RESIDENT CARD residing in this consular jurisdiction.

 

 

  1. CATEGORIES OF CITIZENSHIP BY DESCENT

The following categories may help you find out which one applies to your case:

  • Category 1 (direct descent):father born in Italy, Italian citizen at the moment of your birth and you never renounced your right to Italian citizenship.
  • Category 2 (direct descent):mother born in Italy, Italian citizen at the moment of your birth – occurred after January 1, 1948 – and you never renounced your right to Italian citizenship.
  • Category 3:father born in Oman or other Country (except Italy), your grandfather was Italian at the time of his birth and neither you nor your father ever renounced your right to the Italian Citizenship.
  • Category 4:mother born in Oman or other Country (except Italy), your grandfather was Italian at the time of her birth and neither you, born after January 1, 1948, nor your mother ever renounced your right to the Italian Citizenship.
  • Category 5:your direct paternal or maternal ancestors were born in Oman from Italian parents and they never renounced their right to Italian citizenship.
  1. DOCUMENTATION TO SUBMIT

All documentation must be submitted in original and will be kept in a file at the Embassy of Italy in Muscat.

  1. Application forms:
    • Form 1 – (to be filled out EXCLUSIVELY on a computer);
    • Form 2; declarations of applicant
    • Form 3 – an individual form must be completed and signed by each living person in your Italian line of descent
    • Form 4 – an individual form must be completed for each deceased person in your Italian line of descent and must be signed by you (the applicant).
  2. Application fee in OMR to be paid in cash at the Embassy;
  3. Copy of passport and ID/resident card;
  4. Birth certificate of the Italian ascendant born in Italy (to be issued by the Comune (City Hall) in Italy);
  5. Proof of residency (electricity or other utility bill);
  6. All original vital records certificates for the applicant and his/her Italian ascendants
  7. CERTIFICATE OF NATURALIZATION:

In case your Italian born ancestor never naturalized, please provide:

ORIGINAL CERTIFICATE OF NON-EXISTENCE OF RECORDS;

 

ATTENTION

The documentation must complete and correct at the time of submission. Please double-check all the data and general information on each document. Any discrepancies or inconsistencies must be corrected by the interested party themselves through an official declaration issued by the local authorities, modifying the document to be submitted in support of the application.

KINDLY NOTE

In the event that the documents submitted are not sufficient to determine citizenship eligibility, the citizenship office will request additional documents from the applicant.

Incomplete applications will not be accepted.
